JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 21.3.2016in a case registered for the offences punishable under Sections 341,323,307,498A and 494of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands, making assault and performance of second marriage by the husband of the informant. The informant got married with co accused Dr. Nitesh Kumar Singh on 22.4.2015 but after marriage torture was inflicted for non fulfillment of dowry demands. It is alleged against the petitioner that he abused the sister and mother of the informant and pushed them out from the

Patna High Court Cr.Misc. No.18629 of 2016 (3) dt.28-04-2016 2/2 house. When the informant intervened the accused persons assaulted her with rod, belt, fists and slaps, as a result she became senseless. It is specifically alleged that co accused Krishnanand Singh pressed the neck of the informant.

It is submitted by the learned counsel for the petitioner that specific accusation against the petitioner is of pushing the sister and mother of the informant which did not cause any substantial injury. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria in connection with Morkahi P.S. Case No. 33 of 2016.
