JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 20.12.2014 in connection with Buxar(M) P.S. Case No. 330 of 2014 for the offences instituted under Sections 25(1-b)a, 26 and 35 of the Arms Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that during the course of vehicle checking, the informant alongwith other police forces reached near the Railway Colony, Buxar, at about 18:20 hours. Further it is alleged that after seeing police, two boys sitting on a Yamaha motorcycle, attempted to flee away, they were surrounded by the police and caught hold by them and on search of both persons, from petitioner Praveen Kumar @ Raja Kumar,

One mobile in his left side of waist and Yamaha Motorcycle which was driven by the petitioner Raja Kumar recovered and on demand of the document he could not produce any document and could not explain about the same and both aforesaid arms and motorcycle etc., were seized and accordingly, seizure list was prepared. It has been submitted on behalf of the petitioner that one country made loaded pistol is said to have recovered from possession of the petitioner. It is further submitted that the petitioner has got no criminal antecedent and he is in custody since 20.12.2014.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and there is recovery from his conscious possession.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, in connection with Buxar(M) P.S.
