The petitioner seeks bail in Madanpur P.S. Case No. 95/2019, instituted for offence under Section(s) 414 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. It is a case of mistaken identity. Petitioner was standing at Khiryama More for catching a bus but he was arrested by the police.

It is alleged in the written report that on 23.04.2019, motorcycle of informant was stolen from the campus of Civil Court, Gaya. On 03.05.2019, informant learnt that said motorcycle was at Sherghati. Thereafter informant went to Sherghati and saw two persons were driving the motorcycle.

Patna High Court CR. MISC. No.47281 of 2019(2) dt.05-08-2019 2/2 Informant chased the motorcycle and near Khiryama More motorcycle was stopped. It is alleged that one person managed to escape but one person was caught, who disclosed his name as petitioner.

In this manner, mere suspicion has been raised against this petitioner.

Petitioner is in custody since 05.05.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S. Case No. 95/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
