JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2017 By way of present modification application, petitioner seeks extension of time to surrender before the court below.

It has been submitted by learned counsel for the petitioner that petitioner was allowed privilege of anticipatory abil vide order dated 10.08.2017 passed in Cr. Misc. No. 36467 of 2017, with direction to surrender before the court below within a period of four weeks but as the petitioner was not in town and has gone to see his ill son in Punjab and as such he could not surrender within the prescribed time and, therefore, prayed that a further period of six weeks may be allowed to the petitioner to surrender in the court below.

Considering the facts and circumstances of the case I am not going to interfere with the order dated 10.08.2017 passed

Patna High Court Cr.Misc. No.56504 of 2017 (2) dt.22-11-2017 2/2 in Cr. Misc. No. 36467 of 2017, let petitioner surrender before the court below and pray for regular bail and if any such application is filed, the court below after considering the fact that petitioner has been granted the privilege of anticipatory bail, shall pass an appropriate order, preferably on the same day. With the above observation, this application is disposed of.
