JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with JhaJha P.S. Case No. 176 of 2015, registered under Sections 341, 323, 379, 384, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is of snatching the motorcycle of son of the informant by the petitioner, co-accused Pramod Paswan and one unknown, but on chase made by the informant and others, all the accused persons fled away leaving the motorcycle. Learned counsel for the petitioner submits that, in fact, petitioner and the informant are agnates belonging to family of Late Lalu Yadav and there is land dispute in between the petitioner and the informant due to that reason, the present case

Patna High Court Cr.Misc. No.17740 of 2016 (2) dt.29-04-2016 2/2 has been lodged against the petitioner and Pramod Paswan saying about presence of the petitioner and Pramod Paswan. Later on, the informant disclosed the name of third person as Sanjay Yadav, uncle of the petitioner. In fact, no occurrence as alleged in the F.I.R. took place, but due to ulterior motive, this case has been lodged. Further submission is that petitioner is in custody since 02.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Jamui in connection with JhaJha P.S. Case No. 176 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
