The petitioner is languishing in custody for the offences punishable under Sections 8/20(b)(ii)(B) of the N.D.P.S. Act.
From possession of petitioner more than 4 Kg of Ganja was recovered. Petitioner is accused in a case under Bihar Prohibition and Excise Act. The petitioner is in custody since 08.05.2020.
Considering the allegation of recovery of less than commercial quantity of Ganja and period already undergone by the petitioner, let the petitioner, above named, be released on bail after framing of the charges so that trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.3374 of 2021(5) dt.14-07-2021 2/2 satisfaction of the learned Court-below where the case is pending in connection with Special N.D.P.S. Case No.8 of 2020, arising out of Pranpur P.S. Case No. 81 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
