Patna High Court CWJC No.8439 of 2014 dt.08-03-2017 2 / 3 pension claim of the petitioner after rectifying the mistake and further prayed for payment of arrears as well as current pension after fixation of the pension.

2. A counter affidavit has been filed on behalf of the respondent-Food Corporation of India, making following statements in para 7 to 9:- "7. That, it is respectfully submitted that pension claim of the petitioner after rectifying the mistake has been settled and accordingly P.P.O. No.

BR/MUZ/00091632 has been prepared and issued on 14.07.2016 by which petitioner's monthly pension has been fixed Rs. 1489 with effect from 09.05.2007.

8. That it is stated that a copy of the said P.P.O. has also been sent to Branch Manger Punjab National Bank, Bela Industrial Estate Muzaffarpur.

9. That, it is further submitted that total due arrear amount of pension has also been calculated Rs.1,63,393.00 as per law and fixed procedure and the same has been paid."

3. It is submitted by the learned counsel for the respondent nos. 4 to 6 that since the grievances of the petitioner have already been redressed, the writ application has become infructuous.

4. In view of the aforesaid statements made in the

Patna High Court CWJC No.8439 of 2014 dt.08-03-2017 3 / 3 counter affidavit and the submission made by the learned counsel for the respondent nos. 4 to 6, learned counsel for the petitioner seeks leave to withdraw the application.

5. Accordingly, the writ application is disposed of as infructuous.
