The petitioner is accused in connection with Barauni Rail P.S. Case No. 06 of 2016, registered under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation on receiving information about gathering of accused persons to commit theft in the train. The Police apprehended Sudhir Kumar Mahton, Niranjan Mahtoon Delip Mahton (Petitioner), Sibu Kumar, Mani Kant Kumar, Govind Kumar and Nami Kumar. Thereafter, search was made. The petitioner was found in possession of one licence hotel card, which is not the theft
Patna High Court Cr.Misc. No.19466 of 2016 (2) dt.05-05-2016 2/2 article, which would appear from the F.I.R. itself. The petitioner having no criminal antecedent is in custody since 06.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 06 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
