The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Rohtas P.S. Case No. 247 of 2018 for the offence punishable under Section 302 of the Indian Penal Code.

The allegation in the present case is regarding the petitioner having pressed the neck of the father of the informant and strangulated him resulting in his death.

The learned counsel for the petitioner has submitted that there was dispute between the brothers on account of which some scuffle had taken place, however, there was no intention on the part of the petitioner to kill his brother. I have heard the learned counsel for the parties and perused the materials on record and I find that the informant is an eye witness to his father being strangulated by the petitioner herein resulting in his death. I further find that there are ample materials in the case diary to indicate the complicity of the petitioner in the alleged crime, hence no case is made out for grant of bail to the petitioner herein.
