JUSTICE SUDHIR SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420 and 406/34 of the Indian Penal Code. Allegation against the petitioner is that although he is only the holder of the mobile from which calls were made but he along with other accused asked informant to deposit money on different dates in the bank accounts under different names. It has been submitted on behalf of the petitioner that he is in custody since 6.3.2016. He has got no criminal antecedent. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence.
The money has been deposited in the account of co-accused Jitendra Singh and Anand Kishore. As far as petitioner is concerned, it is alleged that the mobile number of the petitioner is said to have been used in the alleged occurrence. It is further submitted that the mobile number of the petitioner was cloned and petitioner had no knowledge regarding the same. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
Patna High Court Cr.Misc. No.19283 of 2016 (3) dt.26-05-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur P.S. Case no. 257 of 2014.
