JUSTICE MADHURESH PRASAD ORAL ORDER 12-04-2018 Heard learned senior counsel for the petitioner as well as learned counsel for the State and the informant. Petitioner is an accused in a case registered for offence under section 376 IPC and under sections 6 and 4 of the POCSO Act.
Learned senior counsel for the petitioner submits that the victim girl has not disclosed the parentage of the perpetrator of the crime and the same has been disclosed by her parents. Petitioner is in custody since 7.10.2017.
Learned counsel for the informant submits that the petitioner committed rape on the informant's seven years old daughter and sign of nail struck has been found on the chest and cheek of the petitioner.
Considering the gravity of the allegation, this Court is not
Patna High Court Cr.Misc. No.12983 of 2018 (3) dt.12-04-2018 inclined to grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected.
