Petitioner seeks bail in a case registered under sections 147, 148, 149, 323,325 of the Indian Penal Code. It is submitted on behalf of the petitioner that this is a case of misuse of privilege of bail and the petitioner is in custody since 24.02.2015. It is further submitted that petitioner undertake that he shall be present on each and every date in the case fixed.

It is submitted on behalf of the State that this is a case of misuse of privilege of bail and because of the petitioner the trial of the case has been hampered.

No.29362 of 2015 (2) dt.05-08-2015 2/2 Considering eh aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/ (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Bagaha in Tr. No. 1603 of 2014 arising out of Ramnagar P.S. Case no. 48 of 1989, subject to the conditions that petitioner shall be present on each and every date fixed in the case, failing which the court below shall be at liberty to cancel the bail of the petitioner.
