====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-07-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Pakribarawan P.S. Case No.95 of 2019 registered under Sections 420 and 467/34 of the Indian Penal Code besides Section 7 of the E.C. Act.

The accusation is that when the Fair Price Shop of the petitioner was inspected, the required registers were not found up-to-date.

Learned counsel for the petitioner submits that, in fact, when the petitioner was sitting near the shop of Vijay Lal, then a pickup van loaded with rice and wheat was searched but there is no complaint against the petitioner in respect of the

Patna High Court CR. MISC. No.45412 of 2019(2) dt.23-07-2019 2/2 distribution of the food grains to the consumers. Moreover, the licence of the fair price shop dealer of the petitioner has already been suspended by the Government. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Bimlesh Kumar, Judicial Magistrate, First Class, Nawada, in connection with Pakribarawan P.S. Case No.95 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
