The petitioner seeks bail in a case registered for the offences punishable under Sections 366 and 34 of the Indian Penal Code.

Satendra Bharti the elder brother of the husband of Bhibha Bharti alleged that the petitioner kidnapped Bhibha Bharti. It is submitted that the entire allegation is false and concocted. Bhibha Bharti made her statement under Section 164 of the Cr.P.C. under the influence of her family members. Bhibha Bharti has lodged Matrimonial Case No. CS-211 of 2011 in Jalandhar for declaration that Bhibha Bharti is the legally wedded wife of the petitioner. Bhibha Bharti the victim earlier filed case against her husband and other family members under Sections

Patna High Court Cr.Misc. No.30869 of 2015 (2) dt.18-08-2015 2/2 498A, 323, 406 and 34 of the Indian Penal Code. It is submitted that the victim herself went to the resident of the petitioner and made story of her kidnapping. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in Rajepur P.S. Case No. 51 of 2011.
