2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Basantpur (Lakri Nabiganj O.P) P.S. Case No. 667 of 2025, lodged on 06/12/2025, under Section 103 and 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against four named accused persons other than the present petitioner. The allegation is that they assaulted the son of the informant due to which he sustained injury.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is not named in the FIR. Counsel submits that the criminal antecedent of the petitioner is clean. Counsel submits that during investigation the petitioner was seen fleeing away from the place of occurrence. Counsel submits that one of the co-accused, whose name is in the FIR, has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 12.05.2026 passed in Cr. Misc. No. 31957 of 2026. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State, on the other hand, opposes the prayer for bail of the petitioner and submits that from the rejection order it only transpires that he has been seen fleeing away from the place of occurrence.
6. Considering the fact that nobody had seen the petitioner committing any offence but he had been only seen fleeing away from the place of occurrence and considering his antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on

No.47759 of 2026(2) dt.22-07-2026 3/3 furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned A.C.J.M-I, Siwan in connection with Basantpur (Lakri Nabiganj O.P) P.S. Case No. 667 of 2025 subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
