Learned counsel for the petitioners is permitted to remove the defect/(s), as pointed out by office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners seek regular bail in connection with Shivsagar P.S. Case No. 311/2022 for the offences punishable under Sections 341/323/326/307/504/34 of the I.P.C. As per the prosecution case, the allegation against petitioners are that they have involved in assaulting the

Patna High Court CR. MISC. No.49116 of 2022(2) dt.09-12-2022 2/2 informant and his daughter by means of Gandasa and Tangi on their head.

Learned counsel for the petitioners submits that both the parties are agnates and due to dispute of the land the occurrence took place. However, both the parties have compromised and the nature of injury on the victims are simple and the petitioners are languishing in jail since 11.07.2022 and they have no criminal antecedent.

Learned A.P.P. for State opposes the prayer of regular bail of the petitioners Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Rohtas at Sasaram in connection with Shivsagar P.S. Case No. 311/2022.
