JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Darouli P.S. Case No. 194 of 2015, registered under Section 414/34 of the Indian Penal Coded and Section 25(1-b)a, 26, 35 of the Arms Act.

The accusation is that during the course of raid, when Police reached near Kanala choura, then found two persons boarded on a motorcycle started fleeing. On chase, one person was apprehended by the Police, who disclosed his name as Aditya Kumar and the name of his associate as Ranjeet Singh. On search, a country made loaded pistol along with a mobile was found in possession of co-accused Aditya Kumar. He has also disclosed the name of petitioner having hand in the dacoity

Patna High Court Cr.Misc. No.20766 of 2016 (2) dt.18-05-2016 2/2 cases. Thereafter, petitioner was apprehended from brick-kiln of Rinku Singh and on search, one country made pistol along with two live cartridges were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner having no criminal antecedent is in custody since 07.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Siwan in connection with Darauli P.S. Case No. 194 of 2015. Out of two sureties, one surety must be the parents / close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
