JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and the name of petitioner came in this case in confessional statement of coaccused, who was caught by the informant and other police officials.
No doubt, petitioner carries criminal antecedent of several cases but except the criminal antecedent as well as the so called confessional statement of the aforesaid co-accused, there is nothing against the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two
Patna High Court Cr.Misc. No.20593 of 2016 (2) dt.19-05-2016 2/2 sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S.Case No. 68 of 2015.
