The petitioner is an accused in connection with Kesariya P.S. Case No. 285 of 2015, registered under Sections 304(B), 201/34 of Indian Penal Code, pending in the Court of Sub-Judge-II, Motihari, East Champaran.
The accusation is of killing of the daughter of the informant by her husband and other in-laws due to non-fulfillment of demand of dowry.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the deceased used to talk on mobile with other person, when this petitioner made objection, the deceased, wife of the petitioner, locked the door and committed suicide. Learned counsel for the State vehemently opposed the
Patna High Court Cr.Misc. No.19614 of 2016 (3) dt.12-07-2016 2/2 prayer of the petitioner submitted that, admittedly, the petitioner is the husband of the deceased, who died within six months of her marriage in unnatural circumstances.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
