The matter has been taken up out of turn since the petitioner has to appear in 3rd and 4th Semester examination of I.T.I. which is going to be commenced from 25.07.2015. Supplementary affidavit to that effect has been filed today.

The petitioner is languishing in custody since 16.04.2015 in a case registered for the offences punishable under Sections 385 and 387 of the Indian Penal Code. It is alleged that extortion demand of Rs.Ten lakhs was made by making call on the mobile of the informant. The FIR was lodged against unknown, but the name of the

Patna High Court Cr.Misc. No.27004 of 2015 (2) dt.21-07-2015 2/2 petitioner sprang up during investigation on the confession of coaccused Sanjiv Kumar. It is submitted by learned counsel for the petitioner that except confession no material has been collected against the petitioner during investigation. The investigation has already concluded.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Shyampur Bhatha P.S. Case No. 17 of 2015.
