JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 302/120(B) of the Indian Penal Code, 27 Arms Act. Accusation is that on 17.1.2009, Sikandar Rai, the brother of the informant, was going on Hero motor cycle and reached at the house of the member of Panchayat Samit, namely, Dinesh Sahani and at 12. 15 P.M. Dinesh Sahani informed on mobile of Arun Rai that three miscreants killed Sikandar Rai by fire arms. The informant has raised suspicion against the petitioner and others.
Learned counsel for the petitioner submits that except suspicion there is no other material against the petitioner. The petitioner is in custody since 18.03.2016. It is further
Patna High Court Cr.Misc. No.20779 of 2016 (2) dt.19-05-2016 2/2 submitted that similarly situated co-accused, namely, Nathuni Roy, has been granted bail by a bench of this Court in Cr. Misc. No. 48144 of 2014.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rosera, District- Samastipur in connection with Rosera P.S.Case No. 09 of 2009.
