Petitioner is not named in the first information report but in course of investigation apprehended accused made their confessional statements naming one Sundar Kapar as their associate. The learned court below rejected the prayer for bail of the petitioner only on the ground that father's name of the aforesaid Sundar Kapar tallied with the father's name of the petitioner. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Rajesh Pandey, Judicial Magistrate, Ist Class, Vaishali at Hajipur/concerned court in Baligaon P.S. Case no. 82/2012.
