The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case no. 53 of 2016, registered under Sections 302, 201/34 of the Indian Penal Code.
The accusation is that in the evening Pankaj Kumar Singh, grandson of Badri dealer came at the house of informant along with one person boarding on motorcycle and accompanied to his son Nitesh Kumar at about 8.32 P.M. Thereafter, Pankaj Kumar Singh, informed on the mobile of his elder son that at Durga Asthan Nitesh Kumar died due to accident. Thereafter, informant along with others went there and found his son dead and motorcycle was also lying there. The informant raised suspicion that Pankaj Kumar Singh with the help of his friend after administering intoxicated material pressed
Patna High Court Cr.Misc. No.56930 of 2017 (2) dt.07-12-2017 2/2 his neck and gave the colour of vehicle accident. Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. In course of investigation informant, in his restatement, as detailed in para 8 of the case diary, only stated that this petitioner also run shop nearby the shop of his deceased son Nitesh and both were good friend except that nothing has been collected by the I.O. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-IV, Rosera, in connection with Bibhutipur P.S. Case No. 53 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
