JUSTICE SUDHIR SINGH ORAL ORDER 11-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Puraini P.S. Case No. 17 of 2014 for the offences instituted under section 392 of the Indian Penal Code.

The prosecution story, in brief, is that on the alleged date of occurrence while the informant was returning after collecting money from the market by his motor cycle and when he reached near Karama College, two unknown persons boarding on another motor cycle over took the informant and thereafter two more unknown persons on another motor cycle came there and on the point of fire arms they took away mobile phone and cash worth Rs.1,50,000/- from the possession of the informant and

Patna High Court Cr.Misc. No.16480 of 2015 (2) dt.11-06-2015 fled away.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and he is in custody since 26.02.2015 but till date no T.I. parade has been conducted to ascertain his participation in the alleged occurrence. Further it has been submitted that the name of the petitioner has appeared on the statement of one Sudhanshu and that the petitioner may be released from custody after competition of six months in custody.

On behalf of the State it has been submitted that the name of the petitioner has appeared in course of investigation and he has played an active role in committing the alleged offence. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completing six months in custody on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri P. K. Chaudhary, Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in connection with Puraini P. S. Case No. 17 of 2014.
