JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-01-2023 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned counsel for the informant.
The petitioner apprehends his arrest in connection with Chairaiya (Shikarganj) P.S. Case No. 218 of 2012, registered for the offences punishable under Sections 341, 323, 307, 354, 379, 504, 34 of the Indian Penal Code.
As per allegation, the accused persons badly assaulted the informant and his family members. The specific allegation against the petitioner is that, he assaulted the son of the informant with khanti on his head.
Learned counsel for the petitioner has submitted that there
Patna High Court CR. MISC. No.49239 of 2022(3) dt.16-01-2023 2/2 is case and counter case. Both the sides have sustained injuries. The injury report has been prepared in private nursing home. On the other hand, learned counsel for the informant has submitted that the injuries suffered by the son of the informant is grievous in nature and process under Section 83 has been issued. In my view, the petitioner is not entitled for anticipatory bail. Accordingly, it is rejected.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
