Mr. Diwij Raj ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-09-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State as well as learned counsel for the informant.

2. The petitioners apprehend their arrest in a case registered for the offence under Section 137(2)/96/3(5) of the BNS.

3. As per F.I.R., these petitioners with the help of other co-accused named in the F.I.R. kidnapped the informant's minor daughter when the victim had gone to Kapraul Bazar for to buy some articles. It is further alleged that the accused persons including these petitioners kidnapped the daughter of the informant with the intention to marry her or to sell her.

4. Learned counsel for the petitioners submits that specific accusation of kidnapping is againt Manish Paswan with whom daughter of the informant was on talking terms. Petitioners have been made accused only because they happen to be parents of the main accused Manish Paswan.

Patna High Court CR. MISC. No.47598 of 2025(3) dt.16-09-2025 2/2 Petitioners are labourers and petitioner No. 1 works in K.H. Creation, Nagloi, Delhi and on the alleged date of occurrence, they were at their place of work i.e. at Delhi. Petitioners claim clean antecedent.

5. Learned counsel appearing for the informant has opposed the bail petition.

6. Considering the aforesaid facts & circumstances, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge VI cum Special Judge, POCSO, Sitamarhi, in connection with Riga P.S. Case No. 153 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482(2) of BNSS, 2023.
