JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 324, 307, 354(B), 34 of the Indian Penal Code. Petitioner is named in the first information report, but according to the prosecution case itself, it was co-accused Sunil Kumar Tatma, who gave dagger blow to injured persons of the case.

So far as petitioner is concerned, it is only stated that he along with several other accused assaulted the injured persons by means of lathi and another weapons. The injury reports of both the injured have been annexed with this petition and it would appear from the aforesaid injury reports that the injuries of the aforesaid

Patna High Court Cr.Misc. No.20448 of 2016 (2) dt.13-05-2016 2/2 injured had been caused by sharp cutting weapon. No injury said to be caused by hard and blunt substance was found on both the aforesaid injured persons.

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Araria in connection with Jokihat P.S. Case No.17 of 2016.
