Petitioner, already in custody, seeks bail in connection with Bettiah Muffasil P.S. Case No.413 of 2017, registered under Section 366A of the Indian Penal Code.

Allegation in brief is that one Sujit Ram enticed away the victim and brought her to the house of the petitioner where Sujit Ram and this petitioner raped her.

Learned counsel for the petitioner submits there is no allegation of kidnapping the girl against this petitioner and medical report does not show any recent sign of rape; whereas learned counsel for the State submits that there is specific allegation by the prosecutrix that this petitioner also raped her and the medical examination was done after lapse of few days

Patna High Court Cr.Misc. No.15213 of 2018(2) dt.20-03-2018 2/2 and if medical examination is done after few days no sign of rape can be found.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Bettiah Muffasil P.S. Case No.413 of 2017 pending in the court of learned CJM, Bettiah, West Champaran.
