====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------------- 26-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Araria P.S. Case No.840 of 2017 registered under Sections 406 and 408 of the Indian Penal Code.

The allegation of the informant Pravin Kumar Mishra, the Branch Manager of Bharat Financial Inclusion Limited, Shivpuri, Araria, is that the petitioner being the Sangam Manager of Bharat Financial Inclusion Limited, Shivpuri Branch, Araria, collected Rs.7,55,419/ from several beneficiaries but did not deposit the same and misappropriated the same.

Learned counsel for the petitioner submits that, admittedly, the petitioner is the Sangam Manager of Bharat

Patna High Court Cr.Misc. No.11057 of 2018 (2) dt.26-02-2018 2/2 Financial Inclusion Limited, Shivpuri Branch, Araria, and show cause notice dated 08.12.2017 was issued to the petitioner by the Bharat Financial Inclusion Limited for the loss of Rs.3,00,000/- due to non performing the duties by the petitioner properly with a direction to reply the same within two days but without awaiting the reply to the show cause notice of the petitioner, the informant has lodged the present case making allegation against the petitioner of misappropriating Rs.7,55,419/-, while in the show cause notice, only Rs.3,00,000/- is said to be caused loss by the petitioner due to non-performing of duty properly by him. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No.840 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
