The petitioner seeks bail in connection with Tarari P.S. Case No.06 of 2015 for the offences punishable under Sections 341, 324, 326, 307,120B and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution story, in brief, is that on 30.01.2015 at 05.30 P.M. while the informant was getting drain constructed, Pramod Kumar Rai (petitioner) came abusing and in the meantime, the mother of the petitioner came from her house having rifle in her hand and handed over to the petitioner and she exhorted him to kill the informant upon which petitioner fired from his rifle with intention to kill him causing injuries in his right hand and in the right side of his stomach. Thereafter he fell down .

Patna High Court Cr.Misc. No.21862 of 2015 (2) dt.11-06-2015 2/2 The family members of the informant, on hearing the sound of firing reached there and he was taken to Karuna Hospital for treatment.

It has been submitted on behalf of the petitioner that the petitioner is alleged to have fired upon the informant causing firearm injury and the said injury is said to be grievous in nature. It has further been submitted that the petitioner has no criminal antecedent and he is in custody since 11.03.2015. It has further been submitted that the petitioner may be released after completion of nine months in custody.

On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the fact that the petitioner is in custody only since 11.03.2015, let the petitioner, above named, be released on bail, after completion of nine months in custody, on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Tarari P.S. Case No.06 of 2015.
