JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2016 The petitioner is languishing in custody since 21.12.2015 in a case registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act and Section 25(1-B)a, 26, 35 of the Arms Act.

The prosecution case is that on confidential information that miscreants are carrying ganja, raid was laid when two persons namely Bishwajeet Kumar and Vijay Kumar were apprehended. From the possession of co-accused Mannu Kumar one country made loaded pistil and one cartridge were recovered whereas from the possession of this petitioner one country made pistol and one live cartridge were recovered. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that ganja was recovered from the possession of the petitioner and the investigation has already concluded.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, II, Patna in connection with Special Case No. 52 of 2015, arising out of Beur P.S.
