JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 28.1.2015 in Panduaul P.S. Case No.15/15 for the offences under Sections 399, 402, 400, 467, 468, 471/34 of the I.P.C. and Section 25(1) (b)- A/26/34 Arms Act and Section 3⁄4 of Explosive Substance Act. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that when the informant received a secret information that some miscreants were coming on a passenger vehicle for committing dacoity in Madhubani he having prepared a special task force along with police personnel started searching vehicles on Sakri Pandaul main road in course of which a passenger vehicle was stopped from which the passengers started fleeing away but ten miscreants were
Patna High Court Cr.Misc. No.27130 of 2015 (2) dt.29-07-2015 2/2 apprehended by them who disclosed their names. It has been submitted on behalf of the petitioner that he is in custody since 28.1.2015 and charge sheet has already been submitted in this case. No arms is said to have been recovered from the possession of the petitioner. He has been made accused in the present case due to mistake of fact.
It has been submitted on behalf of the State that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Madhubani, in Pandual P.S. Case No.15/15.
