JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Barun P.S. Case No. 189 of 2017 registered for the offence punishable under sections 379, 411, 420, 120B/34 of the Indian Penal Code and sections 3, 4, 5 of Bihar Illegal Mining Act and section 75/80 of Minor Mineral Rules, 2017.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner is the owner of the truck in question and his truck was carrying Sand with valid challan as would be appearing from the Challan annexed as Annexure-2 to this petition. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.62885 of 2017(2) dt.22-12-2017 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 189 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
