2. The petitioner seeks regular bail in connection with Muffasil P.S. Case No.83 of 2023 lodged under Sections 302, 307, 326, 354(B)/34 of the IPC.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 20.07.2024 passed in Cr. Misc. No.43666 of 2024.

4. Learned counsel for the petitioner further submits that the petitioner is in custody since 12.05.2023 and progress report has been called for.

5. Learned counsel for the State opposes the prayer for bail and submits that from the report, it transpires that out of 9 charge-sheet witnesses, only 2 witnesses have been examined

Patna High Court CR. MISC. No.49966 of 2025(3) dt.12-09-2025 2/2 till date and trial court has demanded 5 months more to conclude the trial.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner at present. Therefore, the bail application of the petitioner is hereby rejected.

7. However, speedy trial is a constitutional vision of justice. Therefore, it is hereby directed to the Superintendent of Police, Saran at Katihar to do the needful and instruct the SHO and I.O. to this case to adduce the witnesses for examination within the said period of 6 months.

8. Registry is directed to communicate this order forthwith to the Superintendent of Police, Katihar. Registry is further directed to hand over a copy of this order to learned A.P.P. who shall communicate this order to the Superintendent of Police, Katihar at his level.
