The petitioners apprehend their arrest in Goraul P.S. Case No. 209 of 2017 registered under Sections 341, 323, 308, 354, 379 and other sections of the Indian Penal Code. The informant named the petitioners and alleged that while the informant was sitting on his darwaza, the accused persons armed with different weapons came. Shatrudhan Singh, petitioner no. 1, assaulted the informant on his head with garasa and other accused persons are also alleged to have assaulted the informant and his family members.
The learned counsel for the petitioners submits that the occurrence took place on 19.08.2017, but, the informant, lodged the case on 25.08.2017. Rinku Devi made her fardbeyan on 20.08.10.2017 in the emergency ward of Sadar Hospital, Hajipur, on the basis of which Goraul P.S. Case No. 205 of 2017 was registered on 20.08.2017. Both the sides are co-sharers. The informant got simple injury on his head and other injured persons
Patna High Court Cr.Misc. No.55516 of 2017 (2) dt.12-12-2017 2/2 also got simple injuries. It is submitted that on account of some petty dispute both sides entered into scuffle and assault. Considering the nature of allegation and the fact that both sides entered into scuffle and assault, but, the injuries found on the injured are simple in nature, the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, are directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Goraul P.S. Case No. 209 of 2017 to the satisfaction of Subdivisional Judicial Magistrate, Vaishali at Hajipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
