2. The petitioners apprehend their arrest in connection with Kharagpur P.S. Case No.143 of 2024 registered for offences under Sections 341, 323, 324, 307, 302, 504, 147, 148, 149, 120B of the Indian Penal Code.
3. Petitioners are accused of assaulting and killing the deceased. The petitioners are absconder also and process of attachment has already been executed as has been informed by the learned counsel for the informant; Mr. Jha.
4. Though this application is not maintainable in view of the attachment having been done but on merits also, it is not a
Patna High Court CR. MISC. No.50608 of 2024(4) dt.29-01-2025 2/2 fit case for anticipatory bail.
5. Accordingly, this application for anticipatory bail is dismissed.
6. The petitioners must surrender in the court below within a period of four weeks from today and seek regular bail, if so advised.
7. If the petitioners do not surrender in the Court below within four weeks then the Superintendent of Police, Munger will take all step for arresting the petitioners.
8. If the petitioners surrender within four weeks then the Court below will consider the bail application of the petitioner no. 01 on the ground that he is 75 years old and the allegation against him are distinguishable from other coaccused. (Sandeep Kumar, J) Shishir/- U
