The petitioner is languishing in custody since 28.11.2014 in a case registered for the offences punishable under Sections 384, 385 and 387 of the Indian Penal Code. The accusation is of demand of extortion of rupees thirty lakhs through phone leading to registration of the FIR against three unknown. The name of the petitioner sprang up when the petitioner confessed his guilt.
It is submitted by learned counsel for the petitioner that the petitioner has not connected with the mobile through which the extortion demand was made and even assuming the accusation no offence under Section 384 IPC is made out.
Patna High Court Cr.Misc. No.27157 of 2015 (2) dt.31-07-2015 2/2 Moreover, the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 1022 of 2014.
