JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.
No doubt, petitioner carries criminal antecedent of several cases but in the present case, except confessional statement of co-accused, Jawed @ Chouaa, there appears to be nothing against him. Moreover, petitioner is in jail custody since 03.02.2016 and up till now, police did not take pain to arrange the Test Identification Parade of the petitioner. Moreover, co-accused, Jawed @ Chouaa has already been granted privilege of bail by this

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 525 of 2015.
