This application for anticipatory bail arises out of Bairiya P.S. Case No. 129 of 2020 for the offence under Section 394 of the Indian Penal Code and under Section 37(c) of the Bihar Prohibition and Excise Act.

Considering the nature of allegation levelled against this petitioner, this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and seek regular bail, the Court below shall consider the same and pass appropriate order without being influenced by this order.
