====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 325, 354, 504, 506/34 of the Indian Penal Code.

As per the prosecution case, on account of petty dispute, an altercation took place, in which the tooth of the informant broke. It is further alleged that co-accused Abhinash Kumar assaulted the informant with rod on his head, as a result of which, he sustained injuries.

Specific accusation of assault is against co-accused Abhinash Kumar.

So far as this petitioner is concerned, there is general and omnibus allegation. Petitioner has got not criminal antecedent. Learned counsel appearing for the State vehemently

Patna High Court CR. MISC. No.50135 of 2022(2) dt.15-12-2022 2/2 opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, DistrictPatna, in connection with Athmalgola P.S. Case No. 194 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
