JUSTICE SANJAY PRIYA ORAL ORDER 3/ 30-08-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Tiyar P.S. Case No.54 of 2018 instituted for the offence under Section(s) 420, 467, 468, 506, 120-B Indian Penal Code.
In the written report, it is alleged that accused persons have executed sale deed of the land of informant in favour of Hari Charan Singh in conspiracy. It is alleged that this petitioner is one of the witness of the sale deed.
Counsel for the petitioner submits that petitioner is not beneficiary of the aforesaid land.
Counsel for the petitioner further submits that other co-accused including Haricharan Singh have been granted bail
Patna High Court CR. MISC. No.47342 of 2019(3) dt.30-08-2019 2/2 by different co-ordinate Benches of this Court. Counsel for the informant has opposed the prayer for bail.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Ara, Bhojpur, in connection with Tiyar P.S. Case No.54 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
