JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in case registered under Sections 302, 201 and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that on recovery of one female dead body, Sahiyara P.S.Case No. 101 of 2015 was instituted against unknown persons on the basis of fardbeyan of Chowkidar. In course of investigation the dead body was identified by one Gaya Thakur as his wife Urmila Devi, who raised suspicion against the petitioner and others having murdered his wife due to land dispute. Except suspicion, there is nothing against the petitioner . It is further submitted that similarly situated other co-accused, Ram Lakhan Thakur, has been allowed bail by this Bench on
Patna High Court Cr.Misc. No.19696 of 2016 (2) dt.11-05-2016 2/2 11.04./2016.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Sahiyara P.S.Case No. 101 of 2015. Out of two bailors, one bailor must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
