Petitioner seeks bail in a case registered under section 392 of the Indian Penal Code.
According to the F.I.R. the informant along with his friend went on splendor motorcycle from Rosera to Beur Chouk for collecting amount from the various shopkeepers. After collecting the amount when he reached at Basbatti he found three persons standing near the Bajaj Discover motorcycle and they snatched their mobile phone. Thereafter snatched the key of motorcycle and also snatched Rs. 3 lacs from the Dickery and Rs. 1,73,500/- from his pocket.
It is submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.27470 of 2015 (2) dt.31-07-2015 2/2 petitioner is in custody since 11.02.2015 and charge sheet in the case has been submitted. It is further submitted that petitioner is not named in the first information report and there is no recovery from his possession. The petitioner has not been put on T.I.P. to ascertain his complicity in the case. It is further submitted that petitioner may be released after completion of nine month in custody from 11.02.2015.
It is submitted on behalf of the State that petitioner's name has come during the investigation. Considering the aforesaid facts, it is directed that the above named petitioner be released from the jail custody after completion of nine months from 11.02.2015 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Rosera in Singhiya P.S. Case No. 127 of 2014.
