2. The petitioners are in custody since 11.11.2017 in connection with Gopalpur P.S. Case No. 158 of 2017 for the offences alleged under Sections 341, 323, 324 and 302/34 of the Indian Penal Code.

3. It is submitted that the petitioners have been falsely implicated in connection with death of the informant's father only on account of a petty dispute in which the thrust of accusation of assault on the head of the deceased is against coaccused Rahul Kumar. The post mortem report discloses the cause of death as head injury. The allegation against the petitioners who all happened to be lady members of the family of the said coaccused Rahul Kumar is that they assaulted the deceased with legs and threw brick bats at him. The petitioners claim clean antecedents.

4. Be that as it may, having regard to the entirety of

No.6347 of 2018 (2) dt.01-02-2018 2/2 the facts and circumstances of the case, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District West Champaran in connection with Gopalpur P.S. Case No. 158 of 2017, on the following conditions:- (i) That one of the bailors of each of the petitioners shall be their close relatives.

(ii) That the petitioners shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioners will be well represented in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, their bail bonds shall be liable to be cancelled by the learned Court concerned. (iv) The petitioners shall cooperate with the investigation, if not already concluded, and make themselves available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
