JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Paraiya P.S. Case No. 114 of 2015 registered under Sections 302 of the I.P.C. and 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R., as the informant has detailed the name of four accused persons and two unknown having hand in the murder of her husband. In course of investigation, the Police got recorded the confessional statement of Raja Yadav, who disclosed having hand in the murder of the husband of the deceased disclosing the name of the petitioner and one Md. Taslim. Except the confessional statement, there is

Patna High Court Cr.Misc. No.18989 of 2016 (3) dt.22-06-2016 2/2 nothing against the petitioner. It is further submitted that similarly situated co-accused Md. Taslim has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 6573 of 2016 on 07.04.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gaya in connection with Paraiya P.S. Case No. 114 of 2015.
