The petitioner seeks bail in a case registered under Sections 302, 420 and other sections of the Indian Penal Code. The complainant alleged in her complaint petition that the petitioner forcibly kidnapped her on 19.02.2007 and forcibly got a sale deed executed with regard to 63 decimals of land. She alleged that her husband was also killed six months ago. It is submitted that the investigation is still going on and the Dy.S.P. found the case true only under Sections 467, 468, 420/34 of the Indian Penal Code and not under Section 302 of the Indian Penal Code. The husband of the informant died due to illness. The informant herself executed the sale deed and she did not ever deny the execution of the sale deed before the Sub Registrar. The petitioner happens to be the maternal nephew of the husband of
Patna High Court Cr.Misc. No.18831 of 2015 (2) dt.16-06-2015 2/2 the informant.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui in Sono P.S. Case No. 16/08.
