Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-07-2021 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Nawada Town P.S. Case No. 832 of 2020 instituted for the offence under Sections 341, 323, 325, 307 and 34 of the Indian Penal Code.

The accusation in the First Information Report is that the informant was accosted and assaulted while he was getting shaved in a barber shop. Attack was made by fire arms also but such allegation is attributed to other accused persons, namely, Avinash Kumar and Pawan Kumar. So far

Patna High Court CR. MISC. No.2909 of 2021(2) dt.27-07-2021 2/2 as the petitioners are concerned, they are not said to have done anything. They have been made accused in this case because of their being related to the main accused persons of this case. Avinash Kumar and Pawan Kumar have been granted regular bail by the court below.

Regard being had to the nature of accusation and that the petitioners do not have any criminal case against them so far, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 832 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
