JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 16-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379 and 120B of the Indian Penal Code.

The prosecution case as per the written report of Raju Kumar, State Manager of Divya Nexerjain (Airtel) Tower Company submitted to the Station House Officer of Sangrampur (Tetiya Bamber O.P.) Police Station is to the effect that on 01.01.2017 in the morning the guard informed that 24 batteries of tower has been stolen away by unknown thieves. The petitioner is the guard of the tower.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.2141 of 2018 (2) dt.16-01-2018 2/2 petitioner that no doubt the petitioner was appointed as Guard but since there was no guard room on the tower site, hence, on the cold night the petitioner went to his house and in the morning he saw that the theft was committed and it was the petitioner, who informed the informant about the theft. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Considering the nature of accusation and statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Munger in connection with Sangrampur (Tetiya Bamber O.P.) P.S. Case No. 01 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
