1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118, 109, 303(2), 352 and 3(5) of the BNS.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that he was returning from a function on 05.05.2025 at about 10:00 p.m. when he was intercepted by the petitioners along with 2-3 unknown accused and Harendra Yadav (petitioner no. 2) assaulted him by an iron rod causing injury on
Patna High Court CR. MISC. No.49398 of 2025(2) dt.11-08-2025 2/3 head thereafter Raju Kumar Yadav (petitioner no. 3) assaulted by knife causing injury on cheek while Rama Kant Yadav (petitioner no. 1) assaulted by lathi and snatched chain worth Rs.60,000/-.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that the injury of the injured has been opined to be simple. It is next submitted that though it is alleged that Raju Kumar Yadav (petitioner no. 3) assaulted the informant by knife causing injury on cheek but then from perusal of the injury report, it would manifest that the injury is opined to be caused by hard blunt substance, as such, allegation of assault by knife gets falsified. It is also submitted that on account of previous dispute, an altercation had taken in which both sides assaulted each other.

Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioners but then are not in a position to rebut the submissions of the learned counsel appearing on behalf of the petitioners that the injury suffered by the injured is simple in nature caused by hard blunt substance.
6. Considering the submissions made by the learned

No.49398 of 2025(2) dt.11-08-2025 3/3 counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with G.B. Nagar P.S. Case No. 197 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
