====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sessions Trial No. 255 of 2017 arising out of Sikty ( Bardaha) P.S.Case No. 97 of 2017 (S.R. No. 1785 of 2017) instituted for the offenses punishable under Sections 341, 323, 354 (B) and 376 of the Indian Penal Code.

As per written complaint lodged by the informant is that on 18.04.2017 at about 11 P.M. when she went to sleep but door remained open, the accused persons entered in her house and tried to commit rape upon her and when she raised alarm, nearby persons assembled there and caught hold the petitioner and he was handed over to the police.

It has ben submitted that the petitioner is innocent

Patna High Court Cr.Misc. No.15309 of 2018(3) dt.11-04-2018 2/2 and has falsely been implicated in this case due to enmity. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 19.04.2017.

Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- III, Araria in connection with Sessions Trial No. 255 of 2017 arising out of Sikty (Bardaha) P.S.Case No. 97 of 2017 (G.R.N.o. 1785 of 2017).
